Las reformas laborales en España. Un modelo agotado

Nuestro objetivo es analizar en que medida las últimas reformas laborales introducidas en España han conseguido reducir la dualidad laboral entre trabajadores con contratos indefinidos y temporales. Nuestro análisis se centra en especial en las políticos de fomento de la contratación indefinida y en la reforma del ano 2006, cuyo resultado ha sido muy limitado. El actual proceso de reforma laboral no debería centrarse en soluciones parciales, que no solo han sido ineficaces, sino también muy costosas. Corregir las disfuncionalidades de nuestro mercado de trabajo requiere que se desarrolle una reforma laboral de carácter estructural e integral, que erradique definitivamente la dualidad laboral legal y aborde cambios sustanciales en la negociación colectiva, en las prestaciones por desempleo y en las políticos activas del mercado de trabajo.

In this paper, we analyse to what extend recent labour market reforms have succeeded in reducing the labour market duality between workers with fixed-term and open-ended contracts in Spain. Specifically, we focus our analysis on the reform implemented in 2006 whose main measures were the extension of the coverage of contracts with lower redundancy payments and some changes in the length and amount of the incentives to reduce involuntary turnovers. Our main conclusions are that these measures, as well as those implemented in previous reforms, have had very limited results. Future labour market reforms should not be based on partial measures that have proven ineffective in the past, but on a structural and integrated basis. In particular, they should address four challenges: the suppression of the legal duality between temporary and open-ended jobs, as well as other substantial changes aimed at modernizing the collective bargaining structure, the unemployment benefits system and at improving the effectiveness of the active labour market policies.
