El papel de las diputaciones y mancomunidades en la administración local española

Nacidas en la Constitución de 1812, las provincias, como división territorial del Estado, y las diputaciones, como administración circunscrita a este territorio,se basaron en la estructura departamental francesa. El Estatuto de Calvo Sotelo configura la provincia comouna organización de apoyo y de sustitución de los municipios en la satisfacción de fines e intereses de índole local y en tal estado de cosas se alcanza la actual Constitución. La aparición en nuestro panorama político-administrativo de las comunidades autónomas obligaa una reformulación del papel que hayan de desempeñarlas entidades locales supramunicipales, su relación con las diputaciones provinciales y el papel que actualmente tienen los consorcios como entes asociativos. Encuanto a sus funciones no cabe olvidar que, legalmente, son fines propios y específicos de la provincia garantizar los principios de solidaridad y equilibrio intermunicipales, en el marco de la política económica y social. Por último, desde la perspectiva fiscal, no esposible la asignación óptima si no existe cooperaciónentre las distintas unidades de gobierno.Stemmingfrom the 1812 Constitution, the province, as the territorial division of the State, and the "diputación" orprovincial council, as the organ of government circumscribed by this territorial unit, were based on the French departmental structure. Calvo Sotelo's Statute situates the province as an organisation of support and substitution for the municipalities in the satisfaction of ends and interests of a local nature and this is the state of affairs in which the present Constitutionwas drafted. The appearance of the Autonomous Communities on our political and administrative scene calls for the restatement of the role to be played by the supramunicipal local authorities, their relationship withthe provincial councils, and the role currently played by the municipal consortia as associative entities. As for their functions, we should not forget that, legally speaking, assuring the principles of inter-municipal solidarity and balance, within the framework of economic and social policy, are ends pertaining specifically to the province. Lastly, from the point of view of taxation, optimum budgeting is not possible if thereis no cooperation between the different units of government.
